Privacy Policy
Responsible party
The party responsible for data processing on this website is named in our Impressum (legal notice). You can find our contact details there.
General information
The following notes give a simple overview of what happens to your personal data when you visit this website or use our software products. Personal data is any data that can be used to identify you personally. For detailed information on data protection, please refer to the sections below.
Server log files
This website is hosted on Vercel. When you access this site, the server automatically records access data in so-called server log files. This typically includes: the IP address used, browser type and version, operating system, referrer URL, hostname, time of access, and the amount of data transferred.
This data is processed for the purpose of delivering the website, ensuring stability and security, and resolving technical issues. The legal basis is Art. 6(1)(f) GDPR (legitimate interest). Log data is generally retained only as long as necessary for these purposes.
Analytics (Vercel Web Analytics)
We use Vercel Web Analytics to understand how our website is used. Vercel Web Analytics is privacy-focused: it does not use cookies, does not collect personally identifiable information, and does not track individual users across sessions or sites. Data collected is limited to aggregated, anonymized metrics such as page views, referrer source, browser type, and device category.
Because no cookies or personal data are involved, no consent is required under GDPR for this form of analytics. We disclose it here for full transparency. Vercel Web Analytics data is processed by Vercel Inc. (USA) under their data processing agreement. You can learn more at vercel.com/docs/analytics.
Contact form (website)
If you use our contact form, we process the data you provide (name, email address, message text) solely to respond to your enquiry. Emails are sent and processed via Resend (Resend Inc., USA). We do not use your data for marketing unless you have given separate consent.
The legal basis is Art. 6(1)(f) GDPR (legitimate interest in answering enquiries) or, where applicable, Art. 6(1)(b) GDPR (pre-contractual measures). We retain contact form data only as long as needed to handle your request and any follow-up.
FluentOverlay desktop application
FluentOverlay is a desktop application for Windows. All core data processed by the application (shortcut packs, custom shortcuts, tabs, prompts, snippets, themes, settings, favourites, and layout preferences) is stored and processed exclusively on your local device using a local SQLite database. We do not collect telemetry, crash reports, usage analytics, or any behavioural data from the app. No application data is sent to Fluent Studio or to any third party.
If you install or update FluentOverlay via the Microsoft Store, the Store's own privacy policy applies to that process; we do not receive personal data from the Store beyond what is necessary for the transaction (e.g. purchase receipt for license validation).
In-app contact and bug report forms (FluentOverlay)
FluentOverlay includes optional 'Contact us' and 'Report a bug' forms accessible from Settings. If you choose to use these forms, the data you enter (name, email address, message or bug description) is transmitted to Resend (Resend Inc., USA) for email delivery to our support address. This is the only scenario in which data leaves your device from within the FluentOverlay application.
Submitting a form is entirely voluntary. The legal basis is Art. 6(1)(a) GDPR (consent through voluntary submission). We retain this data only as long as needed to process your enquiry.
Automatic update check (FluentOverlay)
If you enable automatic updates in FluentOverlay's settings, the application periodically sends an HTTPS GET request to a manifest file hosted on our website to check whether a newer version is available. This request contains only standard HTTP headers (IP address, user-agent); no personal data, device identifiers, or usage information is transmitted.
You can disable automatic update checks at any time in Settings → General. The legal basis is Art. 6(1)(f) GDPR (legitimate interest in providing software updates and security patches).
Third-party services and data processors
We use the following third-party services to operate our website and products:
Vercel Inc. (USA) — website hosting, deployment, and web analytics. Vercel processes server log data and anonymized analytics data under their data processing agreement.
Resend Inc. (USA) — email delivery for the website contact form and FluentOverlay in-app contact/bug report forms. Resend processes only the data submitted in the respective form (name, email, message).
LemonSqueezy (USA) — license validation and payment processing for FluentOverlay Pro (direct purchases). LemonSqueezy processes payment and license data under their privacy policy.
Where data is transferred to the USA, appropriate safeguards are in place (Standard Contractual Clauses or equivalent).
Your rights
Under the GDPR you have the right to: access your personal data (Art. 15); have inaccurate data rectified (Art. 16); request erasure (Art. 17); request restriction of processing (Art. 18); data portability (Art. 20); and to object to processing based on legitimate interests (Art. 21). If we process your data on the basis of consent, you may withdraw that consent at any time without affecting the lawfulness of processing before withdrawal.
To exercise these rights, please contact us using the details in the Impressum.
Legal basis summary
We process personal data only where we have a legal basis: consent (Art. 6(1)(a) GDPR), performance of a contract or pre-contractual steps (Art. 6(1)(b) GDPR), compliance with a legal obligation (Art. 6(1)(c) GDPR), or our legitimate interests (Art. 6(1)(f) GDPR) where they are not overridden by your interests or fundamental rights.
Right to lodge a complaint
You have the right to lodge a complaint with a supervisory authority, in particular in the EU member state of your residence, place of work, or place of the alleged infringement, if you believe that the processing of your personal data violates the GDPR. The competent supervisory authority for Saxony is the Sächsische Datenschutz- und Transparenzbeauftragte (SDTB).
